EULA - End User License Agreement

END-USER LICENSE AGREEMENT

This End-user License Agreement ("EULA") is a legal agreement between you, the end-user,
and AKAMARSOFT.
All the rights and warranties covering the Software are
stated in this EULA.

By downloading, installing or using the Software, by loading or running the Software, or by
placing or copying the Software onto your computer hard drive, computer ram or other
storage, you are agreeing to be bound by the terms of this agreement.
If you do not agree to the terms of this agreement delete the Software from your computer.

1.TRIAL PERIOD AND REGISTRATION

This product is copyrighted Software.
You may use the demo version at no charge for an evaluation period of 30 days only.
To continue to use the Software beyond the 30-day evaluation period, you must register it.
A registration fee is required.

2.GRANT OF LICENSE

This EULA grants You a right to use a copy (copies) of the Software.
The Software may be used in any compatible computer, which is owned, leased or otherwise
controlled by You, provided that You can use the Software in one or more computers at a time.

This site license allow anyone or everyone in your company to use the Software.

This is time limited license. The registration period is one year.
After each registration period you have to renew the license
if you want to use the software for the next one year.
The Software may contains code which limits the use of the Software after registration period.

You hereby shall agree that all rights, including copyright and title to or interest in
the Software, diskettes and other material are and shall remain with AKAMARSOFT.
AKAMARSOFT owns this Software, and copyright laws, international treaty provisions, and all
other applicable national laws protect it.

This EULA gives You a limited right of use only, which is revocable in accordance with
this EULA.
You agree that You will not assign, sublicense, transfer, pledge, lease, rent or share
your rights under this EULA.
You may not sell Your rights to a third party without prior written permission from
AKAMARSOFT.
In the case of such a sale You must pass all material received to the approved third party,
and any backup copy in Your possession must be erased or otherwise destroyed.

You must not install the Software to any manufacturing process control system or a system,
which, when disturbed, could effect adversely any processes or activities.

3. RESTRICTIONS

You are not allowed to modify or copy the Software except that You may make a copy (copies)
solely for backup or archival purposes.

You may not reverse engineer, decompile, or disassemble the Software, except and
only to the extent that such activity is expressly permitted by applicable law
notwithstanding this limitation.

The Software is licensed as a single product. Its component parts may not be separated.

You may not rent or lease the Software.

You may permanently transfer all of your rights under this EULA, provided you retain
no copies, you transfer all of the Software (including all component parts,
the media and printed materials, any upgrades, this EULA), and the recipient agrees to
the terms of this EULA.
If the Software is an upgrade any transfer must include all prior versions of
the Software.

Without prejudice to any other rights, AKAMARSOFT may terminate this EULA if you fail
to comply with the terms and conditions of this EULA.
In such event, you must destroy all copies of the Software and all of its
component parts.

4.REDISTRIBUTING THE SOFTWARE

You are free to distribute unmodified copies of the Software, under these conditions:

Distribute only the demo version. The registered version are for your own use only.

You must supply either the original installation file.

Your documentation must explain prominently that this is demo version, that a more recent
release may be available on line, and that the user must purchase a registration from
AKAMARSOFT, as explained in the program documentation.

You are specifically prohibited from charging for any such copies.

You may redistribute the Software under these terms even if you have not registered it yourself.

5.COPYRIGHT

All title and copyrights in and to the Software (including but not limited to any
images, photographs, animations, video, audio, music, text, "applets" and "midlets" incorporated
into the Software), and any copies of the Software are owned by AKAMARSOFT
or its suppliers.
The Software is protected by copyright laws and international treaty provisions.

6. LIMITED WARRANTY

The Software is provided "as is" without warranty of any kind, either express or implied,
including without limitation, any warranty of merchantability and fitness for a particular
purpose.

AKAMARSOFT has tested the Software, but you assume the entire risk as to the results and
performance of the Software.
AKAMARSOFT assume no responsibility for the accuracy or application of or errors or omissions
in the Software.
In no event shall AKAMARSOFT be liable for any direct, indirect, special, incidental or
consequential damages arising out of the use or inability to use the Software, even if
AKAMARSOFT has been advised of the likelihood of such damages occurring.

AKAMARSOFT shall not be liable for any loss, damages or costs, arising out of, but not limited
to, lost profits or revenue, loss of use of the Software or the media, loss of data or equipment,
the costs of recovering the software, the media, data or equipment, the cost of substitute software,
media, data or equipment or claims by third parties, or other similar costs.

Since local legislation in some countries does not allow any exclusion or limitation of
implied warranties or limitation of liability for incidental or consequential damages;
the above limitations or exclusions may apply to you only partly or not at all.

In any event, if any statute implies warranties or conditions not stated in this eula,
AKAMARSOFTs entire liablity under any provision of this license agreement shall be limited
to the amount actually paid by you to license the Software.

7. NO WARRANTY FOR UNREGISTERED USERS

There is no Limited Warranty or product support for unregistered users of the Software.

8. PERFORMANCE

AKAMARSOFT does not guarantee there are no imperfections or errors in the Software.
The Software will not intentionally cause any malicious behavior.
The Software creates and maintains certain Registry entries for the sole purpose
of product usage and registration information management.

9.PRIVACY PROTECTION

Any personal information disclosed to AKAMARSOFT as a result of registration will be held
confidential and will not be disclosed to any third party for commercial or non-profit
purposes.

10. PORTABILITY

By the reason of many system configurations (especially in the world of Linux)
we cannot guarantee that the Software will work under all operating systems.

You can test or use the Software for an evaluation period.
In that period you can check does the Software work or it doesnt.

11. GENERATED MIDLETS

Distributing (commercially or not) generated midlets is allowed only for registered users.

By the reason of many versions of Java in mobile phones and other devices
we cannot guarantee that the generated midlets will work under all phones.

Also we cannot guarantee that its work will be errorless, perfect and functional.

Girtab is a developer tool, so generated midlets may need testing.
